Ministerial Directions under section 499 of the Migration Act 1958 are not legislative instruments. They are not registered on the Federal Register of Legislation, and when a direction is revoked, the Department routinely removes it from publication. The current instrument is always available; its predecessors often are not.

Our policy notes quote and compare these instruments. So that those notes rest on something durable after the instruments they cite are superseded, we preserve the records they rely on, each marked with its provenance and the date it was captured. Those records are held on file and are not republished on this site. What we hold is listed below. If you need to see any of it, ask us.

What we hold

  • Direction 102, order for considering and disposing of Family visa applications. Revoked by Direction 117. Captured 31 July 2026. The copy we hold carries no date in its signature block; Direction 117 records it as dated 9 February 2023.
  • Direction 106, assessing the genuine entry and stay requirements for Student and Student Guardian visa applications. Commenced 23 March 2024, revoking nothing. It applies to applications made on or after that date and is current, operative guidance rather than a superseded instrument. Captured 31 July 2026.
  • Direction 108, assessing the genuine temporary entrant criterion for Student and Student Guardian visa applications. Commenced 23 March 2024, revoking Direction No. 69. It applies to applications made before 23 March 2024 and not finally determined on that date; Direction No. 106 covers applications made on or after it. Captured 31 July 2026.
  • Direction 112, order of consideration for the Subclass 858 visa. Revoked by Direction 120. Text as recorded in the Department of Home Affairs internal LEGEND system, captured 31 July 2026, at which date that record carried the status Current.
  • Direction 117, order for considering and disposing of Family visa applications. Signed 24 July 2026, commenced the day after signing. Captured 31 July 2026.
  • Direction 120, order of consideration for the Class BX visa. Signed 24 July 2026, commenced the day after signing. Transcribed from the signed instrument, captured 31 July 2026.
